BunToon Terms of Use
Welcome to BunToon.
These Terms of Use ("Terms") govern your access to and use of BunToon and related services (collectively, the "Services") operated by Shanghai Yizhitu Information Technology Co., Ltd. ("we," "us," or "our"). Please read these Terms carefully, especially the clauses that may limit or affect your rights, including service rules, user responsibilities, limitation of liability, governing law, and dispute resolution.
By creating an account, signing in, tapping to accept, accessing, or using the Services, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree to these Terms, please do not use the Services.
1. Definitions
"BunToon" means the client application, websites, mini programs, and other forms of products or services that we provide.
"Services" means the features, content, tools, AI image generation, account services, paid features, and other related services provided through BunToon.
"User" or "you" means any person who accesses or uses the Services, whether registered or not.
"Your Content" means photos, text, prompts, images, profile information, and other content that you upload, submit, generate, publish, or otherwise provide through the Services.
"AI-generated Content" means images or other content generated by artificial intelligence models based on Your Content or instructions.
"Service Rules" means all rules, notices, product instructions, activity rules, help center content, and other policies that we publish from time to time.
2. Scope of These Terms
These Terms are entered into by you and us and have legal effect between both parties. Service Rules, specific feature terms, product rules, and payment-related terms are supplements to these Terms and form an integral part of these Terms.
For certain features or products, we may provide additional terms. You should read and agree to the applicable additional terms before using those features or products. If additional terms conflict with these Terms, the additional terms will apply to the relevant feature or product unless otherwise stated.
3. Eligibility, Accounts, and Security
You confirm that you have the legal capacity required to use the Services. If you are under 18 years old, you must use the Services only with the consent and under the supervision of your parent or legal guardian.
You may use the Services through guest access, mobile number login, Sign in with Apple, or other third-party login methods supported by us. When you authorize a third-party login, you agree that we may receive the public account information necessary to create or link your BunToon account, such as your nickname, avatar, or email address, subject to your authorization and our Privacy Policy.
Your account is for your own use only. You are responsible for keeping your account credentials, device, and login status secure. All activities conducted through your account will be deemed your own actions unless you can prove that they were not caused by your fault.
If we reasonably believe that your account or use of the Services may endanger account security, service security, or the rights of others, we may take measures such as verification, warning, limiting features, suspending access, or terminating the account in accordance with these Terms and applicable laws.
4. Services and AI-generated Content
BunToon provides AI-powered image generation, photo stylization, image processing, account features, paid features, and other related services. The exact features may vary by app version, device, operating system, region, account status, and service availability.
When you use AI generation features, you may upload photos or provide prompts. The system may generate new images or other content based on your input. Your uploaded content and AI-generated Content are collectively referred to as Your Content.
AI-generated Content is probabilistic and may be inaccurate, incomplete, unrealistic, offensive, or unsuitable for your intended use. You are responsible for reviewing and deciding whether to rely on, publish, save, share, or otherwise use AI-generated Content.
You must not remove, alter, hide, or misuse any label or notice indicating that content was generated or processed by AI, where such label or notice is provided.
5. Paid Features, Credits, Unlock Tickets, and Membership
Some Services may require payment or the use of in-app virtual benefits, including credits, Unlock Tickets, membership benefits, or other paid features.
Credits are generally used to create works or use generation-related features. Unlock Tickets are generally used to unlock works for saving or other eligible uses. The available products, package contents, billing cycle, validity period, price, tax, currency, refund eligibility, and benefits are subject to the information shown in the app, the relevant app store, and the applicable product page at the time of purchase.
We do not promise that credits, Unlock Tickets, membership benefits, or other virtual benefits have cash value, are transferable, or can be exchanged for money or other property, unless expressly required by law or stated by us. You may not trade, resell, transfer, lease, lend, or otherwise dispose of virtual benefits outside the channels officially provided by us.
Paid products and virtual benefits are digital products or online services. Refunds, cancellations, subscriptions, and renewals are subject to applicable laws, app store rules, payment channel rules, and the specific product terms displayed at purchase.
6. User Conduct
You are responsible for Your Content and your use of the Services. You represent and warrant that you have the necessary rights, permissions, or lawful basis to upload, submit, process, generate, publish, save, or share Your Content.
You must not use the Services to generate, upload, publish, transmit, store, or share content or conduct that:
violates any applicable law or regulation;
infringes any intellectual property, portrait, privacy, reputation, personal information, or other lawful rights of others;
contains illegal, defamatory, fraudulent, hateful, harassing, obscene, pornographic, violent, terrorist, extremist, or otherwise harmful content;
harms minors or exploits minors in any way;
impersonates others or misrepresents your identity or affiliation;
interferes with network security, service operation, or other users' normal use;
attempts to reverse engineer, attack, bypass, overload, scrape, or otherwise misuse the Services;
uses AI-generated Content for unlawful, harmful, misleading, discriminatory, or rights-infringing purposes;
violates public order, public morality, platform rules, or the rights and interests of any third party.
If you violate these Terms, we may take measures including warning, rejecting generation requests, removing or blocking content, restricting features, suspending or terminating your account, preserving relevant records, reporting to competent authorities where required, and pursuing legal liability.
7. Intellectual Property
Unless otherwise stated, all rights in the Services, software, technology, interfaces, designs, logos, trademarks, text, images, data, and other materials provided by us belong to us or our licensors. Without our prior written consent, you may not copy, distribute, modify, display, mirror, upload, download, lease, sell, sublicense, or otherwise use our intellectual property except as necessary for your normal use of the Services.
Subject to applicable laws and these Terms, you retain the rights you lawfully own in Your Content. You grant us a non-exclusive, worldwide, royalty-free license to process, host, transmit, display, reproduce, and technically adapt Your Content solely to provide, maintain, protect, and improve the Services, handle user support, enforce these Terms, and comply with legal obligations.
You understand that if Your Content contains third-party rights, you are responsible for obtaining all necessary permissions. If your use of Your Content causes any third-party claim, dispute, loss, or liability, you shall bear the corresponding responsibility and indemnify us for losses caused by your breach where permitted by law.
8. Personal Information and Minors
We protect personal information in accordance with our Privacy Policy. Please read the Privacy Policy carefully to understand how we collect, use, store, share, and protect personal information.
If you are under 18 years old, you must use the Services with the consent and guidance of your parent or legal guardian. Parents and guardians should supervise minors' use of online services and payment features and should properly protect payment devices, accounts, passwords, and verification codes.
9. Service Changes, Suspension, and Termination
We may update, change, suspend, or discontinue all or part of the Services based on business development, technology updates, security needs, legal requirements, or user experience improvements.
We will use reasonable efforts to provide notice where required by law or where a change materially affects your rights. If you do not agree to a change, you should stop using the Services. Your continued use of the Services after the change takes effect means that you accept the updated terms or rules.
10. Disclaimers and Limitation of Liability
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we do not guarantee that the Services will be uninterrupted, error-free, secure, always available, or suitable for any particular purpose.
AI-generated Content may contain errors or unexpected results and does not represent our views. You should not rely on the Services as a substitute for professional advice in medical, legal, financial, safety, or other professional fields.
We are not liable for service interruptions or losses caused by factors beyond our reasonable control, including network failures, device failures, third-party service issues, cyberattacks, viruses, power outages, natural disasters, government actions, judicial or administrative orders, or force majeure events, except where liability cannot be excluded under applicable law.
11. Governing Law and Dispute Resolution
These Terms and any dispute arising out of or relating to these Terms or the Services shall be governed by the laws of the People's Republic of China, unless applicable law provides otherwise.
If a dispute arises, both parties shall first attempt to resolve it through friendly negotiation. If negotiation fails, either party may bring a lawsuit before a competent court at the defendant's domicile, unless applicable law provides otherwise.
12. Miscellaneous
If any provision of these Terms is held invalid, void, or unenforceable, the remaining provisions will remain valid and enforceable.
The headings in these Terms are for convenience only and do not affect the interpretation of any provision.
